Customer Requirements:

At GC Jet Ski Hire, we prioritize safety for all our customers. As per our Self Hire and Drive Regulations, customers are strictly prohibited from being under the influence of ALCOHOL OR DRUGS while riding our jet skis. Safety is paramount, and therefore, we provide a comprehensive safety briefing that is essential for all participants to view and understand. Additionally, all participants must successfully complete the accompanying test before departing on any of our safaris. Failure to pass the test will result in the inability to travel with us. We kindly request customers to arrive 30 minutes prior to their booking for check-in and to present the credit card used for online purchases along with matching ID. Please note that jet skiing is not suitable for pregnant customers, and participants must be in good health without any previous neck, back, or spinal injuries or any other medical conditions that may pose a risk. By booking with GC Jet Ski Hire, customers confirm that they, their passengers, or any individuals under 18 listed on the form do not have any current or previous neck, back, or spinal injuries or any other medical conditions that may cause injury to themselves or others participating in the activity.

Cancellation:

In unforeseen circumstances that necessitate the cancellation of a booking by GC Jet Ski Hire, such as circumstances beyond our control, we assure customers of a full refund if rescheduling is not possible.

Weather:

GC Jet Ski Hire operates in most weather conditions and is equipped to provide wet weather gear if necessary. However, if the weather conditions are deemed unsafe due to storms or extreme circumstances, we will take all reasonable steps to reschedule the booking. In the event that rescheduling is not possible, a full refund will be provided to our customers. Please be aware that tour cancellations are solely made by the experienced GC Jet Ski Hire team and may be influenced by any current weather warnings at the time.

Age Restrictions

At GC Jet Ski Hire, we adhere to government regulations regarding age restrictions to ensure the safety and enjoyment of all participants. The youngest age allowed for a pillion passenger is 7 years old or a minimum height of 125cm. Teenagers between the ages of 12 and 15 may have the opportunity to drive the jet ski, accompanied by a rider who is 16 years or older (at the guide’s and management discretion). Teenagers aged 16 and over are permitted to drive the jet ski alone, provided they have a parent or guardian’s signature. Participants must be 16 years or older to take a pillion passenger with parent or guardian consent (also subject to management discretion). We prioritize the safety of our customers and ensure compliance with these age restrictions for a secure and enjoyable experience.

Weight Restrictions

To maintain safety standards and ensure the comfort of our customers, our skis can be comfortably twin shared at no extra cost. However, there are weight restrictions in place. The combined body weight of both riders must not exceed 200 kg. If the total weight exceeds this limit, it is necessary to purchase an additional jet ski, and no refund will be given for the existing jet ski. These weight restrictions are implemented for the safety of our customers, as exceeding the recommended limit can lead to injuries and potential damage to the jet ski. We prioritize the well-being of our customers and strive to provide a safe and enjoyable experience for everyone.

Release and Waiver – GC Jet Ski Hire Pty Ltd:

  1. In this Release and Waiver:

(a) ‘Organiser’ refers to GC Jet Ski Hire Pty Ltd, including its employees, guides, agents, volunteers, and contractors, along with all other parties involved in the organization and conduct of the Activities.

(b) ‘Participant’ denotes the person signing this form, including their heirs, next of kin, representatives, successors, executors, administrators, agents, and assigns.

(c) ‘Event’ signifies the hiring of a jet ski from the Organiser for use by the Participant, either as an operator or passenger at the Gold Coast, Queensland.

(d) ‘Activities’ encompass the Event and include all matters related to it, such as transport to and from the Event, preparations for participation, instructions and training about the conduct and risks associated with the Event, use of equipment during the Event, and all other matters associated with the performance and participation in the Event, including the provision of medical assistance or treatment.

  1. In cases where this Release and Waiver is signed by a parent, guardian, or supervisor of the Participant, they provide consent for the minor’s participation in the Activities and provide acknowledgments, release, and waiver on their own behalf as well as on behalf of the Participant.

ASSUMPTION OF RISK:

  1. The Participant acknowledges that:

(a) Participation in the Activities involves certain risks, including the risk of death, personal injury, and illness due to overexertion or strenuous activity, changing weather conditions, dangerous environments, and limited access to medical support and rescue services.

(b) Participation in the Activities is a voluntary decision made at the Participant’s own discretion, fully understanding and appreciating the nature and extent of all risks involved.

(c) The Activities inherently carry dangers and risks, including the real risk of injury or death.

  1. The Participant agrees not to engage in any reckless or dangerous maneuvers while riding the jet ski, including but not limited to 180s, 360s, or jumps.
  2. If the Participant operates the jet ski during the Event, they must maintain a proper lookout, keep a safe distance from other vessels, objects, and persons, and comply with the rules for preventing collisions at sea. The Participant acknowledges their responsibility for their own safety and the safety of others. We encourage participants to inform a guide if they feel lacking in confidence operating the jet ski or encounter any situation that compromises their own or others’ safety.

RELEASE AND WAIVER:

  1. By participating in the Activities, the Participant agrees to waive any and all claims, both present and future, against GC Jet Ski Hire, releasing the company from any liability for any loss, damage, or expense associated with injury, including death, that the Participant may suffer or sustain as a result of participating in the Activities. This release includes claims arising from negligence, breach of contract, or breach of any statutory or other duty on the part of GC Jet Ski Hire, including any failure to instruct, warn, safeguard, or protect the Participant from any risks associated with the Activities.
  2. This document does not prevent GC Jet Ski Hire from relying on any laws (including statutes and common law) that limit or preclude their liability.
  3. While this document excludes any term or guarantee that cannot be excluded under applicable laws, the liability of GC Jet Ski Hire is limited to the minimum liability allowable by law. Participants should note that they may have rights under consumer guarantees set out in the Australian Consumer Law (Cth) or the applicable consumer legislation of the relevant State, as mentioned below.
  4. This Release and Waiver, along with any rights, duties, and obligations between the Participant and GC Jet Ski Hire, are governed by and interpreted solely in accordance with the laws of Queensland, Australia.

HEALTH INFORMATION – EXISTING MEDICAL CONDITIONS:

  1. The Participant confirms that they are medically fit to participate in the Activities, warranting that they are not aware of any medical or physical condition that might be aggravated by participating in the Activities.

REQUIRED MEDICAL TREATMENT:

  1. The Participant consents to any necessary medical treatment considered appropriate by GC Jet Ski Hire in the event of injury or illness during the course of undertaking the Activities. The Participant agrees to indemnify GC Jet Ski Hire in respect of the cost of any medical treatment required.

Please note that the user assumes full liability for any damages that may occur while riding the jet ski.
